These Terms of Service ("Terms") govern your use of offmarketengine.com and the services of Off Market Engine Inc. ("Off Market Engine," "we," "us"). By using the site, submitting a form or opting in to text messages, you agree to these Terms and our Privacy Policy.
Off Market Engine provides online advertising, landing pages and lead delivery for real estate investors. We deliver qualified seller leads. We do not guarantee any specific number of signed contracts, closed deals or profits. Results depend on your market, budget, follow-up and offers. Specific deliverables, fees, ad budgets and terms for clients are set out in a separate written agreement, which controls if it conflicts with these Terms.
Program: Off Market Engine text messages.
What you'll receive: messages about your application or inquiry, appointment confirmations and reminders, service updates and, if you separately consent, occasional marketing messages.
Opt-in: by checking the SMS consent box on our forms and submitting your phone number. Consent is not a condition of any purchase.
Frequency: message frequency varies, typically up to 10 messages per month.
Cost: Message and data rates may apply. Check with your carrier for details.
Opt-out: To stop receiving messages, reply STOP to any text message. You'll receive one confirmation and no further messages.

Age: You must be 18 years of age or older to use this SMS service.

You must be at least 18 and able to enter a binding contract. Our services are intended for businesses and real estate investors.
Fees and payment terms are agreed in writing before any work begins. Ad spend is paid to the advertising platforms as set out in your agreement.
The site content, branding, ad copy, landing pages and methods are owned by Off Market Engine Inc. or its licensors, unless your written agreement says otherwise.
The site and services are provided "as is." We make no guarantees about lead volume, lead quality beyond any written guarantee in your agreement, deal outcomes or uninterrupted availability. Nothing on this site is legal, tax or investment advice.
To the fullest extent permitted by law, Off Market Engine is not liable for indirect, incidental, consequential or lost-profit damages. Our total liability for any claim is limited to the fees you paid us in the three months before the claim.
You agree to indemnify Off Market Engine against claims arising from your use of leads, your communications with sellers or your breach of these Terms or applicable law.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, and disputes will be resolved in the courts of Ontario. This does not remove any rights you have under the mandatory consumer or communications laws of the place where you live, including U.S. federal and state law.
We may update these Terms. The effective date above shows when they last changed. Continued use means you accept the updated Terms.
